When you sign up for and use the Services, request a quote, complete a form, consult with our customer service team, send us an email, provide your telephone number, or communicate with us in any way, you are voluntarily giving us information that we collect. That information may include either your or your recipient’s name, physical address, email address, IP address, and phone number. By giving us this information, you consent to this information being collected, used, disclosed, transferred to the United States and stored by us, as described in our Terms of Use and in this Privacy Policy.

When you make a payment on The Write Way, you may provide payment information such as your credit card or other payment details. We do not store your credit card information. Our credit card processing vendor, Stripe, uses security measures to protect your information both during and after the transaction is complete. Our vendor is certified as a PCI Level 1 Service Provider.

When you send a note via the Service, we have and may access the sender and recipient address as well as the content within your note (“Note Content”). We use this information to operate, maintain, and provide to you the features and functionality of the Service.

SMS and Mobile Communications:

When you provide your phone number through our website, quote form, contact form, or another method and separately consent to receive SMS communications, The Write Way may use your phone number to send you text messages. Depending on the consent you provide, these messages may include customer service communications, quote or order-related information, appointment or service updates, reminders, promotions, special offers, discounts, and other marketing communications.

Consent to receive SMS marketing messages is optional and is not a condition of purchasing goods or services from The Write Way. Message frequency may vary. Message and data rates may apply.

You may opt out of SMS communications at any time by replying STOP to any text message from The Write Way. After opting out, you will no longer receive SMS messages covered by that consent unless you subsequently opt in again. You may reply HELP for assistance.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

When you visit the Services, a cookie may be stored on your computer. We may share information with service providers that perform limited services on behalf of The Write Way, such as website hosting, payment processing, order fulfillment, technical support, communications infrastructure, analytics, and customer service. These providers are permitted to access information only as necessary to perform services on our behalf and are required to appropriately protect that information.

Mobile information is treated separately. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

The Write Way does not sell phone numbers, SMS opt-in information, SMS consent records, or SMS message data to third parties for marketing or promotional purposes.

  1. Acquirors of our Business or Assets:

We may transfer certain information about you if The Write Way is acquired by or merged with another company, subject to applicable law. In such an event, we will provide notice when required before your personal information becomes subject to a materially different privacy policy.

SMS opt-in data and consent will continue to be handled in accordance with applicable consent requirements and will not be used or transferred to third parties for unrelated marketing or promotional purposes merely as a result of such a transaction.

  1. Legal Requirements:

The information we collect is not sold to other organizations. In addition, The Write Way’s secure servers protect this information using firewall technology.

You should use a security-enabled browser when submitting payment information and other personal information through the Services.

The Write Way accounts require a username and password to log in. You must keep your username and password secure and never disclose it to a third party. Account passwords are encrypted, which means we cannot see your passwords. We cannot resend forgotten passwords; we will only reset them.

If a security breach causes an unauthorized intrusion into our system that materially affects you or your information, The Write Way will provide notice as required by applicable law and take appropriate action in response.

While The Write Way continues to work hard to protect your personal information, no data transmission over the Internet can be guaranteed to be absolutely secure, and The Write Way cannot ensure or warrant the security of any information you transmit to The Write Way. Transmitting personal information is done at your own risk.

4) YOUR CHOICES ABOUT YOUR INFORMATION

  1. Updating Account Information:

You may update your account information and email communication preferences at any time by logging into your account and changing your account settings. If you have any questions about reviewing or modifying your account information, you can contact The Write Way support team. The Write Way will typically respond to your request within 7-10 business days.

  1. Adjusting Notification, Email, and SMS Preferences:

You can stop receiving promotional email communications from us by clicking the “unsubscribe” link provided at the bottom of those communications or by contacting The Write Way support team. We make every effort to promptly process unsubscribe requests.

You may withdraw your consent to receive SMS communications at any time by replying STOP to a text message from The Write Way. After we process your opt-out request, you will no longer receive SMS messages covered by that consent unless you opt in again. You may reply HELP for assistance.

Opting out of promotional SMS communications does not prevent us from providing services you specifically request through other communication channels.

You may not opt out of administrative or service-related communications that are necessary to provide Services you have requested, such as account verification, purchase and billing confirmations, changes to features of the Service, or technical and security notices, except where applicable law requires otherwise.

  1. Deleting Information and Accounts:

The Write Way users can request deletion of their account by contacting The Write Way support team with the subject line “Request for Account Deletion.” Once deleted, your data, including your account, outbox, and stationery, cannot be reinstated.

Following deletion of your account, it may take up to 30 days to fully delete your personal information and system logs from our systems. Additionally, we may retain information from deleted accounts to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the Terms of Service and take other actions permitted by law. Information we retain will be handled in accordance with this Privacy Policy.

5) EU MEMBER’S RIGHTS:

If you reside in the European Union, you have the right to access, rectify, download or erase your information, as well as the right to restrict and object to certain processing of your information. While some of these rights apply generally, certain rights apply only in limited circumstances. We describe these rights below:

  1. Access and Porting:

You can access much of your information by logging into your account. If you require additional access or a copy of your data, The Write Way users can request an export of their personal data by contacting The Write Way support team with the subject line “Request to Export Data.” Requests for data export may require further verification proving that the requester has authority to make the request.

  1. Rectify, Restrict, Limit, Delete:

You can rectify, restrict, limit or delete much of your information by accessing your account. If you are unable to do this, please contact The Write Way support team. The Write Way will typically respond to your request within 7-14 business days.

  1. Object:

Where we process your information based on legitimate interests explained above, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where processing is needed for legal reasons.

  1. Revoke Consent:

Where you have previously provided consent, such as consent to receive promotional emails or SMS communications, you have the right to withdraw that consent at any time.

You may withdraw SMS consent by replying STOP to a text message from The Write Way. You may withdraw promotional email consent by clicking the “unsubscribe” link at the bottom of a promotional email.

  1. Complain:

Should you wish to raise a concern about our use of your information, and without prejudice to any other rights you may have, you may have the right to do so with your local supervisory authority.

  1. Transfers:

The Services are operated from the United States. If you are located outside of the United States and choose to use the Services or provide information to us, you acknowledge and understand that your information will be transferred, processed and stored in the United States as necessary to provide the Services and perform the Terms of Service. United States privacy laws may not be as protective as those in your jurisdiction.

6) LINKS TO OTHER WEBSITES AND SERVICES:

We are not responsible for the practices employed by websites or services linked to or from the Service, including the information or content contained therein. When you use a link to go from the Service to another website, our Privacy Policy does not apply to that third-party website or service. Your browsing and interaction on any third-party website or service, including websites containing links or advertisements on our website, are subject to that third party’s own rules and policies.

7) MEDIATION:

If you are a resident of a country outside of the European Union, you agree that, in the event any dispute or claim arises out of or relating to this Privacy Policy, you and The Write Way will attempt in good faith to negotiate a written resolution of the matter directly between the parties.

You agree that if the matter remains unresolved for forty-five (45) days after notification that a dispute exists, all parties shall join in mediation services in Greenville County, South Carolina with a mutually agreed mediator in an attempt to resolve the dispute.

Should you file arbitration claims or administrative or legal actions without first attempting to resolve the matter by mediation, you agree that you will not be entitled to recover attorneys’ fees, even if you would otherwise be entitled to them.

8) CHANGES TO OUR PRIVACY POLICY

The Write Way may modify or update this Privacy Policy from time to time to reflect changes in our business and practices, and you should review this page periodically. When we change the policy in a material manner, we will provide notice as appropriate and update the effective date of this Privacy Policy.

If you object to changes to this Privacy Policy, you may stop using the Services and request deletion of your account. The Write Way users can request deletion of their account by contacting The Write Way support team with the subject line “Request for Account Deletion.” Once deleted, your data, including your account, outbox, and stationery, cannot be reinstated.
